It is a common misconception that machine guns are illegal to own. The Gun Control Act of 1968 and the National Firearms Act of 1934 (Title 26, USC chapter 53) allow for the private ownership of these weapons providing the provisions in-acted by these laws are met.
Individuals, Trusts, and corporations are allowed to purchase machine guns that are classified as transferable. A transferable machine gun is one that was manufactured and registered as a machine gun prior to May of 1986.
Please note the National Firearms Act restricts several types of Class 3 weapons.
Individual states may also impose additional restrictions in addition to the National Firearms Act on the sale, purchase, or transfer of weapons that may fall within the Class 3 category.
